What Is A Temporary Protective Order?
A temporary protective order or restraining order is a legal document issued by a court upon petition. It protects victims of abuse, whether physical, mental or emotional. It can also include acts of harassment and stalking.
- It often includes a no-contact order: A TPO generally bars communication, verbal and electronic, between the spouses or named parties. This includes contact by way of third parties acting on their behalf. An offending spouse may also be required to move out of a shared home. Neither party can initiate contact unless otherwise specified.
- A TPO can, but does not have to be, granted for the children: Children are named as a protected party under a TPO when their safety is at risk. Exceptions to the parents’ no-contact order exist to allow them to share information about a child or exchange the child under a parenting schedule.
- You will have your day in court: A hearing takes place within 30 days from the date the petition was filed. At this hearing, both sides have the opportunity to share their story with the judge. The judge then has the discretion to extend the TPO for up to 12 months.
- False accusations can have consequences: Challenging a TPO based on false allegations is important. When a TPO is in place, it could affect your parental rights, career, reputation, and other aspects of your life.
- Violating the terms of a TPO can be considered contempt.
